These Terms of Service set out the rules for using the BrainyBookShelf website and buying from us. By browsing this site or placing an order, you're agreeing to them. If you don't agree, please don't use the site.
1. Who Can Use This Site
By using this website you confirm that you're of legal age in the place where you live, or that a parent or guardian has given you permission. We may decline to serve any customer, at our discretion.
2. Our Products
We do our best to describe and photograph our books accurately, but we can't promise that every description, image or colour is exactly right or fully up to date. We may change, limit or stop selling any title at any time without notice.
3. Prices and Availability
Prices are shown in the currency displayed at checkout and can change at any time. If a price is listed in error, we may cancel or decline the affected order rather than honour the mistake.
4. Placing an Order
When you place an order with us, you're confirming that:
- The details you've given are accurate and complete
- You're authorised to use the payment method entered
- Your order may be checked before we accept it
We may cancel or limit any order that appears fraudulent, unauthorised, or in breach of these Terms.
5. Delivery
Delivery estimates on this site are exactly that — estimates, not guarantees. We're not responsible for delays caused by carriers, customs, weather or anything else outside our hands. Full details are on our Shipping Information page.
6. Returns and Refunds
Returns, replacements and refunds are covered by our Returns & Refunds page. Placing an order means you accept what's written there.
7. Digital Products
All digital eBook sales are final. Because eBooks are delivered instantly and can't be returned, we don't offer refunds, exchanges or cancellations once an eBook has been purchased and delivered. This overrides any general return window stated elsewhere on our site: our standard return policy covers printed books only, and digital eBooks are excluded from it. If your eBook file is faulty or won't download, email us and we'll fix it or send it again.
8. Intellectual Property
Everything on this site — text, images, logos, book covers, product descriptions, page design — belongs to BrainyBookShelf or to our suppliers, and is protected by copyright and trademark law. You may not copy, reproduce, distribute or resell any of it without our written permission. This applies to the contents of our books as well as the website itself.
9. What You May Not Do
You agree not to use this site:
- For any unlawful purpose
- To break any law or regulation that applies to you
- To send viruses, malware or any other harmful code
- To interfere with the site's security or normal operation
- To harvest or misuse other people's personal information
- To carry out fraud or deception of any kind
10. Limitation of Liability
So far as the law allows, BrainyBookShelf is not liable for any indirect, incidental, consequential, special or punitive losses arising from your use of this site or our products. Where we are liable for a purchase, our total liability will not exceed what you paid for the item in question.
11. No Warranties
Our site and products are provided on an "as is" and "as available" basis, with no warranties of any kind, express or implied. We can't promise the site will always be available, secure or free of errors.
12. Educational Content
Our books are published for general information and self-development. They aren't a substitute for professional, medical, legal or financial advice, and results will differ from reader to reader.
13. Links to Other Sites
We sometimes link out to other websites. We don't control them and aren't responsible for their content, policies or practices. Visiting them is at your own risk.
14. Changes to These Terms
We may update or replace any part of these Terms at any time. Changes take effect as soon as they're posted here, and continuing to use the site afterwards means you accept them.
15. Governing Law
These Terms are governed by the laws applying where BrainyBookShelf operates, without regard to conflict-of-law rules.
